Greece wants to tax crypto gains at their own rate for the first time: 10% on the profit when you sell, and nothing if your net gain for the year does not exceed 500 euros. The rules are in an omnibus bill from the Greek Ministry of Finance which, according to the newspaper To Vima, was submitted to parliament on 27 October 2026; the committees were due to start on 29 October. The tax would apply to tax years from 1 January 2027. We found no vote at the time of writing, so this is a bill and not yet law.

Greek crypto tax in short

  • 10% on the profit. Gains from selling for euros or from paying with crypto fall under a new Article 42B of the Greek income tax code. The ordinary rate on gains from securities is 15%, according to Taxheaven's analysis.
  • 500 euros a year tax-free. If the net gain for a tax year, after deducting losses, is at or below 500 euros, you pay nothing. If it is above, the explanatory memorandum says the whole gain counts, from the first euro.
  • Swapping one crypto for another: no taxable event. This is stated in the explanatory memorandum to the bill. Tax only arises when you convert to euros or pay for goods or services.
  • Staking, lending and yield farming count as interest. The proceeds count at the moment you receive them, at their value in euros at that moment.
  • Effective 1 January 2027. For sales up to and including 31 December 2026 there will be a voluntary declaration, with no penalty or interest if you pay on time.
  • Not yet law. The bill can change until the vote.

What the bill sets out

The Greek Ministry of Finance first put the bill out for consultation; Reuters and To Vima wrote about it on 8 October. Submission to parliament followed. According to Taxheaven, which goes through Articles 42 to 57, 304 and 390 of the submitted bill, this is what it covers:

TransactionTreatment under the billArticle
Selling crypto for eurosGain, 10%42B and 43
Paying with crypto for goods or servicesCounts as a sale; the value in euros at that moment is the sale price42B paragraphs 2 and 6
Swapping one crypto for anotherNot a taxable disposal (according to the memorandum)memorandum to 48
Mining outside a businessNo income when received; taxed on sale, with a purchase price of zeromemorandum to 48
Staking, lending, yield farmingInterest; the taxed value later becomes the purchase price37
Inheritance and giftCrypto is treated as intangible movable property abroad; value on the day before the tax liability arises51 to 53
Digital transaction taxNot on the sale of crypto, nor when you pay with it54

The purchase price can come from your provider's records or directly from the blockchain. If you buy in instalments, the average purchase price applies. The Greek tax authority (AADE) will set out the details in a later decision.

Losses count only to a limited extent. You can carry a loss forward for five years only if it exceeds 500 euros a year, and only against later crypto gains. You cannot offset it against gains on shares or other income.

Two worked examples

The 500-euro threshold. The memorandum says the exemption falls away as soon as the net gain exceeds 500 euros. This is a worked example on that reading, not a table from the bill:

Net gain in a yearTax (10%)
400 euros0 euros
500 euros0 euros
501 euros50.10 euros
600 euros60 euros

If the 500 euros were a deduction, a gain of 600 euros would have meant only 10 euros of tax (10% of 100). That is not what the memorandum says.

Average purchase price. Taxheaven works it out like this (amounts in euros, costs included): 0.5 BTC for 30,000 plus 100 in costs, and another 0.5 BTC for 40,000 plus 100 in costs. Together that is 70,200 for 1 BTC. Later you sell 0.4 BTC for 32,000, with 80 in costs.

StepAmount
Purchase price of 0.4 BTC (0.4 × 70,200)28,080
Sale price after costs (32,000 − 80)31,920
Gain3,840
Tax (10%)384

Taxheaven notes that it still has to be clarified whether the costs of the sale reduce the sale price; the AADE decision will settle that.

Old gains: voluntary declaration

The bill provides a scheme for anyone who sold crypto before 2027 or earned interest from staking, lending or yield farming. You may file a declaration within twelve months of the law entering into force and pay within sixty days of filing. There are no penalties or interest for late declaration, as long as you pay on time. The gain is taxed at 10%.

Taxheaven gives an example: someone bought for 30,000 euros in 2021 and sold for 40,000 euros in 2025. The gain is 10,000 euros and the tax is 1,000 euros. As proof of your assets, only that 10,000 euros counts, not the 30,000 euros you put in.

This is not an amnesty. According to the memorandum, the AADE continues to check the origin of the money and the costs claimed, and filing a declaration does not mean the origin of your capital has been approved.

Also in the bill: oversight of unlicensed providers

The same law gives the Greek capital market commission new powers against unlicensed providers in Articles 55 and 56. After a hearing, it can ban an activity and have it blocked: websites, apps or accounts in Greece. It keeps a public list of warnings. In urgent cases it can act first and hold the hearing only within ten days. Under the bill, a domain name tied to an unlicensed provider goes offline for two months and is then deleted.

If you want to know whether your platform has a European authorisation, you will find it in our MiCA authorisation register. An authorisation says something about supervision, not about the tax you pay yourself.

What does this mean for you as a European investor?

You pay tax in Greece. Then the bill would treat your gains differently from 2027 onwards. Keep the records of every purchase and sale from now on, with amount and date; the bill works with a purchase price and a sale price. The bill also puts crypto purchases on the list of spending the tax authority uses to check whether your wealth fits your income. Who falls under Greek tax follows from general Greek tax law; we have not checked that.

You live in another country. Then nothing changes for you. Your own country decides your tax, and the rules differ widely. What applies in each country, with sources, is in our overview of crypto tax in Europe. You can read more about Germany in German crypto tax 2027: no cabinet decision yet.

Your platform's reporting duty. Separately from Greece, European platforms will start passing customer data to the tax authorities from 2027. What that involves is in DAC8 crypto reporting: what exchanges send tax authorities.

What is not certain yet

  • The vote. At the time of writing we found no report that parliament has voted. The text can still change.
  • The rate for staking. Taxheaven writes that these proceeds are taxed as interest at the 15% interest rate. CNN.gr writes 10% about the same things. We cannot settle that without the text of the law.
  • The earlier 15%. To Vima wrote on 8 October that the ministry had earlier this year considered 15%; the bill says 10%.
  • Swapping one crypto for another. This is in the memorandum and follows from the design of Article 42B, not from a sentence that says so. Taxheaven mentions reservations here.
  • Costs on sale. Whether they reduce the sale price will only become clear in the AADE decision.
  • The official text. The ministry's page refused the cloud (403) and an archive copy could not be opened. We read the articles through Taxheaven's detailed analysis, which quotes the text of the law and the memorandum, and compared that with To Vima, CNN.gr and Reuters.
